The libel lawsuit filed against The Rhinoceros Times by Greensboro Police Capt. Brian James and Officer Julius Fulmore is being dismissed.

North Carolina Superior Court Judge Edgar Gregory announced today, March 24, 2011, that he is dismissing all claims against The Rhinoceros Times, Jerry Bledsoe, John Hammer and William E.D. Hammer, who were represented by Seth Cohen of Smith, James, Rowlett & Cohen. The official order should be signed later this week.

In an email to Cohen and Amiel Rosabi, who represented James and Fulmore, Judge Gregory wrote, "after careful consideration of the record proper, the affidavits, depositions, legal authorities submitted, the 92 articles that make up the series 'Cops in Black and White,' as well as the arguments of counsel, this Court concludes that there are no genuine issues of material fact as to any of the five claims contained in the Complaint of the Plaintiffs and the Defendants are entitled to Summary Judgment as a matter of law."

The Rhino Times was being sued for defamation for statements in the Cops in Black & White series written by Bledsoe and published in The Rhino Times and a statement in a column written by John Hammer.

The lawsuit was filed in November 2007.

    I hope those plaintiffs have to pay for the Rhino legal costs. Often that is the case with frivolous suits. If you don't ask, you don't get.
